In this episode we examine the Fourteenth Amendment in light of the recent Supreme Court affirmative action case. Rather than following the lead of the majority, we look at it through the lens of what the writers and ratifiers of that amendment meant and said at the time of ratification.
Then, for fun, we walk through the laughable dissenting opinions as well as briefly examine the Left's reaction to the opinion and offer some real solutions to the problem.

Ep. 253 - The Truth About Affirmative Action – The Majority Opinion

Unless you live under a rock, you are aware that the Supreme Court recently struck down the discriminatory, race-based admission standards at colleges and universities on the grounds that they violate the Equal Protection Clause of the Fourteenth Amendment.
In this episode we review the majority opinion authored by Chief Justice John Roberts and a concurring opinion written by Associate Justice Clarence Thomas.
In the next episode we discuss the problems associated with the Fourteenth Amendment (something called the Incorporation Doctrine) as well as review the Left's predictable reaction to the majority opinion and we have a little fun at the expense of Associate Justice Jackson as we review her dissenting opinion.

Ep. 205 - The Truth About June 2022 – The Month the Constitution Made a Comeback

The biggest story of the month was the Supreme Court's annual summertime opinion dump which included a flurry of majority opinions that actually reflected on the constitutionality of several hot-button issues like abortion, the EPA, religious freedom and school choice. Most of these issues never should have been heard by SCOTUS given the limited powers granted to the federal government by the Constitution but, for decades, activist judges have allowed the expansion of federal power making virtually everything a federal case.
In addition to SCOTUS, we had plenty of news from Biden as his administration and the national Democrats continue to behave like a doomsday cult hell bent on destroying the country.
And we saw dozens of stories about the adverse effects of the Covid vaccine - all of which were ignored by the alphabet soup, conspiracy media.

Ep. 75 - The Truth About the Anti-Federalists

When you hear discussions about the Constitution and the Founding Fathers, you are likely hearing about the majority group who supported the new Constitution called the Federalists. However, there was another group of prophetic founders who opposed the Constitution as written for a variety of reasons who were equally important. They are called the Anti-Federalists. These forgotten founders warned about the inevitable growth in size, scope and power of the federal government - especially the judiciary - all at the expense of the individual states.

Ep. 60 - The Truth About Do Something - Red Flag Laws

Following the two most recent mass shootings, the usual cries of DO SOMETHING have resurfaced as they always do following attacks or a crisis. After the Las Vegas shooting, we heard cries for a ban on bump stocks; today it's calls for red flag legislation. These laws, also known as Gun-Violence Restraining Orders, or Extreme Risk Protection Orders allow family members and mental health professionals to petition a court for an order enabling legal authorities to temporarily remove guns from those who are deemed to be a significant danger to themselves or others.

Ep. 46 - The Truth About Roe v Wade - Part I - Sick and Twisted

I think it is safe to say that the Roe v. Wade opinion is the most controversial Supreme Court opinion of the last 50 years. If not, the consequences of it certainly are with over 50 million abortions being performed. But what is the truth about the opinion? How many people have actually taken the time to read it?
Upon reading the opinion, I was struck by the intellectual dishonesty of the majority opinion and the lack of true constitutional analysis. I was also alarmed at the callous manner in which the life in the womb was characterized and the list of so-called valid reasons for ending an innocent life.
In this episode, I introduce or reintroduce you to the Roe case and walk you through Justice Harry Blackmun's majority opinion. At times it is sick and twisted but, in the end, the court surprisingly leaves the door wide open for state regulation of abortion.
Besides leading to the death of tens of millions of innocent lives, this opinion demonstrates just how far activist judges will go in pursuit of their policy preferences. I demonstrate this by dismantling their three primary citations - the right to privacy, the Ninth and the Fourteenth Amendment.
